GENERAL TERMS OF SALE
1. SCOPE OF APPLICATION
These general terms of sale (hereinafter referred to as "GTS") apply to any order placed through the website www.organicdesign.es and derived addresses (hereinafter the "Site") of the company TUO AGENCY REPRESENTACIONES, S.L., domiciled at calle Doctor Fleming, No. 4 Bajo, registered in the Mercantile Register of Alicante with N.I.F. B42655985 and VAT number ESB42655985 (hereinafter "ORGANIC DESIGN").
These GTS apply to the purchase of goods to be delivered in Spain (hereinafter the "Products"). The GTS have been made available to the buyer (hereinafter the "Customer") prior to the order confirmation, which requires prior, express, and unconditional acceptance, prevailing over all previous versions or specifications emanating from the Customer. The GTS accepted by the Customer are incorporated into the contractual documentation accompanying the conclusion of the contract.
2. ORDERS
2.1 Product Offer
The Products for sale are those available at the time of order confirmation and payment by the Customer. Organic Design reserves the right to modify its offer at any time, in particular by adding new Products, removing others, or modifying their presentation.
The Products are presented in accordance with legal recommendations and as accurately as possible. An exact representation of the Products on the Site and/or in catalogs cannot be guaranteed due, in particular, to differences in color finish in Internet browsing software programs and/or device screens. There may be differences between the Products delivered and those represented on the Site or catalog, mainly concerning artisanal Products, whose manufacturing homogeneity cannot be guaranteed, or those Products that have been subject to adaptations related to technical or technological developments.
Customized Products: Products made to measure, according to the Customer's specifications, or that have been customized by the Customer cannot be subject to changes, refunds, or returns for any reason.
2.2 Placing an Order
The Customer has the possibility to place an order by phone by calling the number 673.819.364 or through the Site.
Any order placed through the Site requires the creation of an account (hereinafter the "Customer Account"). The Customer must add the selected Products to their basket (hereinafter the "Basket"). The Customer has the opportunity to verify the details of their order and its total price, being able to make changes before final validation of the order. Orders sent to Organic Design by mail, fax, or any other means other than those indicated will not be taken into account.
2.3 Order Validation
The order is firm and valid, for the Customer, from the moment they confirm it and, for Organic Design, from the validation of payment and confirmation of order processing.
Organic Design reserves the right to reject an order for any legitimate reason.
Organic Design will send by email, as soon as possible, an order confirmation with the essential elements (order number, Products requested, delivery location, etc.).
All orders for Products are subject to availability. In the event of unavailability of one or more requested Products, difficulties in supply, or lack of stock, Organic Design undertakes to contact the Customer by email as soon as possible, informing them of the estimated delivery date; in the case of textiles, they are made to order, and the manufacturing time is 35-40 days after receipt of payment.
PRICE / PAYMENT
3.1 Product Price
The prices of the Products are in euros. Taxes related to the sale of Products, including VAT, are included. Unless otherwise indicated, the prices presented do not include preparation and shipping costs, which will be duly detailed before order confirmation by the Customer.
Organic Design reserves the right to modify the prices of its Products. In any case, the price conditions valid on the date of order validation by the Customer will apply.
3.2 Payment
Payment will be made in full and in euros when placing the order by credit card, bank transfer, Stripe. Orders will be processed once payment is authorized.
3.2.1 Payment by credit card
The following credit cards are accepted: Visa and MasterCard. To prevent internet fraud, Organic Design may verify the authenticity of bank details and/or the Customer's identity prior to order confirmation, always respecting applicable personal data protection regulations. When placing an order on the Site, the Customer undertakes to provide Organic Design with the requested data in accordance with the law, which the latter reserves the right to verify or request the corresponding documents. Any delay in providing the requested information will result in the suspension of the order until verification of said information.
3.2.2 Payment by bank transfer
If the Customer chooses this method of payment, they will receive an email with the necessary information to proceed with the bank transfer. The Products will only be shipped after confirmation of payment by our bank.
DELIVERY
4.1 Delivery Zones
Organic Design delivers its Products in mainland Spain, Balearic Islands, and the European Union countries.
4.2 Delivery Times
Delivery times are approximate and may vary depending on the delivery location. The usual delivery time for Products in stock and in mainland Spain is 24/72 hours after payment confirmation.
The delivery time for textile Products is 35-40 days from receipt of payment, except in cases of force majeure.
In any case, delivery times are indicative; a delay will not give the Customer the right to cancel the order, to refuse the Products, or to claim compensation.
4.3 Delivery Process
Delivery of Products will be made to the delivery address specified by the Customer when placing the order. The Customer undertakes to provide accurate and complete delivery information to ensure proper delivery.
Upon delivery of the Products, the Customer or any person present at the delivery address must verify their conformity with the order, in the presence of the carrier. In the event of a discrepancy between the order and the delivery, the Customer must indicate their reservations in writing on the delivery note and confirm these reservations within three days by registered letter with acknowledgment of receipt addressed to Organic Design, calle Doctor Fleming, No. 4 Bajo, or by email to the address: info@organicdesign.es
4.4 Delivery Costs
The delivery costs are indicated before the order is confirmed and are the responsibility of the Customer.
5. RIGHT OF WITHDRAWAL
The Customer has a period of fourteen (14) calendar days from the date of receipt of the Products to exercise their right of withdrawal without having to justify reasons or pay a penalty.
The Customer must inform Organic Design of their decision to withdraw by means of an unambiguous declaration by email to the address: info@organicdesign.es. Organic Design will acknowledge receipt of this withdrawal by email.
Returned Products must be in their original condition and packaging, unused and accompanied by the invoice. The Customer is responsible for the return costs, and the Products will be returned at their risk. The refund will be made within a maximum period of fourteen (14) days from the date on which Organic Design is informed of the Customer's decision to withdraw.
6. WARRANTY
6.1 Guarantee of Conformity
All Products benefit from the legal guarantee of conformity and hidden defects. In the event of non-compliance of a Product with the order, the Customer must return it to Organic Design, which will take it back, exchange it, or reimburse it, depending on the Customer's choice, and without charge.
The Customer has two years from the delivery of the Product to act. The Customer is reminded that they may choose between repair or replacement of the Product, subject to the cost conditions provided for by law. The Customer is exempt from providing proof of non-compliance of the Product during the twenty-four (24) months following delivery of the Product.
6.2 Warranty Extension
Except for perishable goods, all Products may be covered by a contractual warranty extension. The terms and conditions of this warranty extension are detailed on the Site.
7. LIABILITY
Organic Design's liability is limited to the direct damage caused by the Products sold. Organic Design cannot be held responsible for indirect damage or damage caused by the Customer's fault or for unforeseeable and insurmountable damage inherent in the use of the Internet, such as service interruption, external intrusion, or the presence of computer viruses.
8. FORCE MAJEURE
Neither party will be held liable for any delay or non-performance of its obligations resulting from the occurrence of a force majeure event, as defined by case law.
9. DATA PROTECTION
Organic Design undertakes to preserve the confidentiality of the personal data communicated by the Customer when placing the order and to process it in accordance with the law. The Customer has the right to access, rectify, and delete data concerning them, as well as the right to oppose the processing of their data for direct marketing purposes, by writing to the address indicated in the legal notices or by email to the address: info@organicdesign.es
10. INTELLECTUAL PROPERTY
The Site and all its components (images, texts, videos, etc.) are the exclusive property of Organic Design or its partners and are protected by intellectual property law. Any total or partial reproduction of the Site or its components, by any means, without Organic Design's express authorization, is prohibited and constitutes an infringement punishable by law.
11. APPLICABLE LAW / JURISDICTION
These GTS are subject to Spanish law. In the event of a dispute regarding the validity, interpretation, or execution of the GTS, the parties undertake to seek an amicable solution before any legal action. In the absence of an amicable solution, the dispute will be brought before the competent Spanish courts.
These GTS are available in Spanish and English. In the event of a discrepancy between the Spanish and English versions, the Spanish version shall prevail.
